This seminar will provide an overview of the requirements to complete the vesting of title to a property post death. Briefly, we will touch on De Bonis Non (DBN) Grants and Ad Litem Grants, and when these may be required. We will also review applications to the High Court or to the County Registrar for Orders dispensing with the need for a Grant to complete the vesting of title, and when these Orders might be appropriate, and applications under the Trustees Act, before addressing Contracts for sale by the Legal Personal Representations and requirements of Tailte Eireann to complete registration post death.

Trea McGuinness is a Senior Associate with BHSM LLP Solicitors, specialising in the areas of Wills and estate planning, the creation and administration of trusts, and administration of estates. She also has experience in the setting up and subsequent registration/activation of Enduring Powers of Attorney and in Decision Making Representative applications. Trea has been a member of Society of Trust and Estate Practitioners (STEP) since 2010. She is a long-standing member and current Chair of the Dublin Solicitor’s Bar Association (DSBA) Probate and Taxation Committee and former Committee member of STEP Ireland. Trea is also an experienced residential conveyancer.

Ann Stephenson Principal of Stephenson Solicitors. She is a member of STEP, the DSBA Probate and Taxation Committee and the Probate Administration and Trust Committee of the Law Society. She lectures, examines and tutors on the Law Society’s Professional Courses on Wills Trusts, Probate, Tax Planning and on the STEP Diploma in Wills, Trust & Estate Planning. She also lectures for CPD, Skillsnet, the DSBA, STEP Ireland, SFE and for regional Bar Associations and other Professional bodies. She is the co-author of the Oxford University Press (OUP) Manuals on “Taxation for Solicitors” recently published, “Wills Probate and Estate” 8th edition. She is a contributor to “Laffoy Irish Conveyancing Precedents”- executors and administrators, She also contributes to the Law Society Gazette, the Parchment, and the Irish Tax Review.
Niall Fahy is a barrister and member of the Law Library based in Dublin with a general civil / chancery practice specialising in areas related to succession and probate. Niall was called to the Bar in 2014. He is a former legal researcher in the Law Reform Commission, having been the principal legal researcher on the Commission’s project on Section 117 of the Succession Act 1965, culminating the Commission’s publication of its Report on Section 117 of the Succession Act 1965: Aspects of Provision for Children (LRC 118 – 2017). Niall is a qualified Trust and Estates Practitioner (TEP) and a member of the Society of Trust and Estate Practitioners (STEP) having completed the Law Society’s Diploma in Trust and Estate Planning in 2021.
Clodagh O’Hagan TEP is a partner in the property and private client teams in Mullany Walsh Maxwells LLP. Clodagh acts for commercial and private clients, in both sales, purchases and lease transactions in various sectors. She acts for clients seeking to purchase and sell new and second-hand homes and investment properties. As a Trust and Estate Practitioner she also has practical experience and knowledge of probate, trusts and succession law. She is the current chair of the DSBA Property Committee and a member of STEP.
