Multi-Unit Developments and Owners’ Management Companies

David Rouse, Multi-Unit Developments (MUDs) Advisor with the Housing Agency, will deliver insights for legal practitioners on MUDs (mainly apartments), and owners’ management companies. David’s presentation will cover relevant aspects of law and regulation, including the MUD Act, company law, and management agent regulation.  He will discuss topical issues and relationships in the sector and identify additional sources of guidance for practitioners.

Importance of MUD replies.

What is the recommended practice in relation to requests for undertakings, how to correctly incorporate the replies into the replies to requisitions and the importance of correct replies. Do I need to qualify title when the common areas have not been transferred 13 years on from the enactment of the MUD Act. The impact of fire safety issues in MUDs on conveyancing. Can a house in a MUD where parts of the development have been taken in charge be sold without any reference to a management company? How can the unit deeds be changed if there are errors in service charge apportionments, mapping etc.?

David Rouse is Multi-Unit Developments Advisor with the Housing Agency.  He engages with stakeholders in the MUDs sector, including professional bodies, local authorities, AHBs, State organisations, owners’ management companies, and residents.  David’s work supports sustainability, governance, and best practice in the sector.  He is a Fellow of Chartered Accountants Ireland, and a Business and Law graduate of UCD.

Suzanne Bainton is a partner in the firm of Liston & Co Solicitors in Donnybrook in Dublin. She has developed her knowledge into specialist areas such as multi-unit developments and the acquisition and development of land. Suzanne is involved in the delivery of property related course to students at the Law Society. She has also been involved in a number of property related seminars for solicitors and has spoken extensively on the issue of multi-unit developments. She is the author of the section of the Law Society’s Complex Conveyancing book dealing with apartment developments and is a member of the conveyancing committee of the Law Society and was a member of its task force which engaged with the Department of Justice prior to the enactment of the MUD Act and which prepared the suite of precedents arising from the legislation.
