How to manage risk in commercial contracts-recent developments in contract law

Aideen Burke is a partner in A&L Goodbody’s and Technology Group.

Aideen’s talk will address: Recent developments in contract law: key learnings and how to manage risk in commercial contracts.

Construction Contracts and Risk Management

Angelyn Rowan is a Partner in the Projects and Construction team at Philip Lee.

Angelyn’s talk will address construction contracts and risk management: how to mitigate potential risks from the outset, formation of construction contracts, allocation of key risks, forms of performance security, management and administration of construction contracts, including claims, addressing variations.

The risks and opportunities associated with the operation and interaction of dispute resolution processes when disputes arise.

Damien Keogh is a Senior Counsel, lawyer, arbitrator, mediator, adjudicator

Damien’s talk will examine the key issues relevant to the choice of appropriate forms of dispute resolution mechanisms for incorporation in contracts and agreements, and the risks and opportunities associated with the operation and interaction of dispute resolution processes when disputes arise

Role of in-house counsel in managing risk during a crisis

Mark O’Shaughnessy is a disputes & investigations partner in ByrneWallace LLP.   Mark’s talk with address the risks and challenges for in-house counsel in guiding their organisations through the three phases of managing a crisis: namely (i) Immediate (Stabilisation & Identification), (ii) Medium (Collating Information, Notifications and Engaging with Stakeholder) and (iii) Long Term (Strategic & Tactical).

Angelyn Rowan is a Partner in the Projects and Construction team at Philip Lee LLP. She has extensive experience advising funders, developers, employers and contractors on all aspects of the procurement and construction of major projects. She has advised public sector bodies on the procurement of several State projects, including the National Development Finance Agency on the first healthcare and social housing public private partnerships in Ireland.  Angelyn is recognised in both Chambers and Legal 500 and lectures on the Law Society Construction Law course. Angelyn’s talk will address: construction contracts and risk management- how to mitigate potential risks from the outset, formation of construction contracts, allocation of key risks, forms of performance security, management and administration of construction contracts, including claims, addressing variations.

Damien Keogh SC, lawyer, arbitrator, mediator, adjudicator and conciliator in all types of commercial and contractual disputes. He is a Fellow of the Chartered Institute of Arbitrators, a CEDR Accredited Mediator and a lecturer in arbitration law, adjudication and dispute resolution in Trinity College, Dublin.   Damien is recognised as a “Leading Individual” in Construction law as ranked by the Legal 500, and a “Leader in his field” and “among the World’s leading Construction lawyers” as ranked by Who’s Who Legal: Construction.  Damien is also on the panel of Arbitrators of the Dubai International Arbitration Centre (DIAC), the Abu Dhabi Global Markets (ADGM), the Saudi Centre for Commercial Arbitration (SCCA), the Oman Commercial Arbitration Centre (OAC) and Xi’an Arbitration Commission, China (XAAC).  Damien is also on the Ministers Panel of Adjudicators and is co-Author of the leading legal text “Adjudication Practice and Procedure in Ireland”.

Mark O’Shaughnessy is a disputes & investigations partner in ByrneWallace LLP.   Mark has significant experience of advising business leaders through a diverse range of crisis including financial misappropriation, cyberattacks and adverse media intrusion. Mark has also been appointed by the European Commission as a member of its Expert Group against SLAPP (Strategic Lawsuits Against Public Participation).
